A resident of Sao Jose de Areal, Shirish Kamat has filed a writ petition in the High Court seeking disqualification of Margao MLA Digambar Kamat as member of the Goa Legislative Assembly for the present term, starting from March 2017.
The High Court has issued notices to Digambar Kamat as well as to the Election Commission of Indian returnable on February 17.
The petitioner has prayed to the High Court for a writ of certiorari or a writ in the nature of certiorari or an appropriate writ, order or direction thereby quashing and setting aside the order dated 4/8/2020 passed by the Governor of Goa in the Review Petition no. 1/2020.
The petitioner has further prayed for an appropriate writ, order or direction thereby directing that the Respondent no. 4 Digambar Vasant Kamat, be disqualified as a member of the Goa Legislative Assembly for the present term staring from March 2017.
The contention of the petitioner is that the Margao MLA is liable for disqualification for allegedly taking government contracts either directly or through his proxy as a partner of a firm.
The petitioner claimed that the government contracts were subsisting on the day of elections.
