Saying that Goa is an idea place to host an international arbitration centre, Justice C V Bhadang of the High Court of Bombay at Goa on Saturday hoped the State Advocate General will take the matter with the government so that the centre becomes a reality in the state on the lines of the Singapore International Arbitration Centre.
“Goa is an ideal place for an international arbitration centre like the one in Singapore. The facilities at the Singapore International Arbitration Centre are all state of the art. Why a similar centre has not come up in Goa when it was mooted long ago? I hope the Advocate General will take the matter with the government,” Justice Bhadang said, while addressing a gathering after inaugurating the Arbitration & Mediation Centre and Evidence Recording Centre at the VVM’s Govind Ramnath Kare College of Law, Margao, on Saturday.
Commenting on the success of arbitration in the country, Justice Bhadang said arbitration is not working as was expected and there may be several reasons for it.
Asserting that conciliation too has not made much impact as the mechanism is practically not used by the litigations, Justice Bhadang said it is for the academicians, lawyers, law students and the stakeholders to come out with a solution to the issue.
Referring to the two amendments recently brought about by Parliament to the Arbitration and Conciliation Act, the judge hoped that the amendments will go a long way in making arbitration more effective.
“The Legislature is trying to plug the loopholes and remove the discrepancies in the Arbitration and Conciliation Act through the two amendments,” he said, but hastened to add that the success of the Act will ultimately depend on the stakeholders, including the lawyers and the
litigants.
In his address, Goa Advocate General, Devidas Pangam, said Arbitration and Conciliation as alternate redressal mechanism has not been successful due to the various flaws, including the flaw that people and the litigants are not inclined to take recourse to Arbitration and Conciliation.
Principal of Kare College of Law, Prof Saba Da Silva, said through the Arbitration and Mediation Centre, the law college will offer its good offices for arbitration and mediation, which will serve as a conducive platform for the arbitrators, mediators and
concerned parties to these procedures.
He further said through the Evidence Recording Chamber, the Commissioners appointed by the Court would be provided with facilities required in this regard.
