16 murder cases: Acquittal No 9 for Mahanand

Ruling that he was falsely implicated in the case, Sessions Court, Panaji has acquitted alleged ‘dupatta killer’ Mahanand Naik and jeweler Ulhas Rivonkar in the 2008 murder case of Nayan Omu Gaonkar at Fatorda, Margao.

The judgment states that the chain of circumstances leading up to the alleged murder is incomplete and that not only is this a case of defective investigation but also a case of false investigation whereby Mahanand has been ‘falsely implicated’.
“The evidence which is brought on record shows that the accused has been falsely implicated,” the court has ruled.
While Mahanand was acquitted of the charges under Section 364 (kidnapping), 302 (murder), 392 (robbery) and 201 (destroying evidence) of Indian Penal Code, Rivonkar was charged under Section 411 (dishonestly receiving stolen property)

 The deceased’s (Nayan) sister, Jeevan Lambhor files a missing report on April 7, 2008
 Mahanand is 
arrested on August 15, 2009 in connection with the crime
 Mahand is accused of strangulating Nayan to death and robbed her of gold ornaments
 Rivonkar, a jewelry shop owner at Ponda market, is arrested for receiving the stolen property
 The police lists 52 witnesses of which prosecution examines 19 witnesses, defence two
