The South Goa Sessions Court on Saturday acquitted a 37-year-old labourer Akub alias Raju Lagun who was charged for the offence of murder.
In this case, the Vasco police had charged the accused of having murdered one Mithun, a native of Odisha, with a wooden danda on his head on November 11, 2018, at the Kharewado fishing jetty, over sudden provocation, due to which he sustained head injuries and further succumbed to the injuries.
While acquitting the accused, Additional Sessions Judge Vincent D’Silva observed that though the prosecution has proved that the accused was apprehended immediately after the incident, the prosecution, however, has not established that the accused assaulted the deceased with the wooden danda as there were no fingerprints of the accused either on the danda or any of the exhibits or the bloodstains of the deceased on the person of the accused or the clothes worn by him at the time of the incident.
“There are no sufficient materials adduced on record by the prosecution to implicate the accused in the alleged crime as the alleged eyewitness, Dulal Haldar, a Bengali has not been examined to prove the case of the prosecution to the hilt”, the Judge observed, while acquitting the accused.
