This is despite the High Court earlier finding enough evidence to order the demolition of the structures, yet the police have chosen to file the case as a C - summary indicating that there isn t enough evidence to try Parulekar. In the C summary closure report the police have said that the complaint is “neither true nor false” but has been shut on account of lack of evidence. Judge Deshpande will on August 8 hear arguments by Rodrigues who submitted to the Court that he would strongly oppose the malafide move by the Crime Branch. Earlier, the High Court on the basis of two petitions filed by Trajano D Mello a former NCP and currently Congress politician and the second jointly filed by Gabriel D Souza, a daily wage earner and Yeshwant Shirodkar, a driver, against the alleged land grab by the Tourism Minister Dilip Parulekar, the court had ruled in favour of the petitioners. “The Chief Secretary through the Collector and the North Goa Planning and Development Authority and the Village Panchayat of Socorro, are directed to immediately take action to stop the unauthorized occupation of the subject premises by the Dilip Parulekar and others to in accordance with law and file compliance report,” the court had said. “The Comunidade of Serula and the Administrator of Comunidades are directed to take action in accordance with law against the Dilip Parulekar and others to restore the subject property,” the court said. Subsequently the HC dismissed a review petition filed by one Ashok Shirsat and two others (all shopkeepers on the premises) against an earlier order by the High Court directing the administration to stop the unauthorised occupation of the Serula Comunidade land and asked it to restore the property to its original state.
