Application turned down after repeated failure to allow site inspection, non-compliance

In an interesting development, the Colva panchayat has resolved to reject the application for an Occupancy Certificate from a Noida-based builder that has been in the news recently.
The panchayat has rejected the application as the same could not be processed on merits due to denial of access to the property and failure to facilitate inspection.
The panchayat has informed the builder that his application dated January 15, 2026 seeking issuance of Occupancy Certificate in respect of the bungalows constructed at Colva village was placed before the panchayat body from time to time for consideration. “The panchayat body, vide its earlier Resolution No. 2/1 dated 30/01/2026, had resolved to conduct a mandatory site inspection to verify whether the construction has been carried out in accordance with the approved plans,” the panchayat stated.
“Accordingly, multiple opportunities were granted to facilitate the inspection. However, it has been observed that on all scheduled dates of inspection, including February 04, 2026, February 11, 2026 and April 01, 2026, you and other applicants remained absent, and the property was found locked, thereby preventing panchayat officials from entering the premises and carrying out the required inspection,” the panchayat stated.
The panchayat added: “It is further noted that despite issuance of notices and sufficient opportunities being provided, there was continued non-cooperation on your part, resulting in the panchayat being unable to ascertain the factual position at site. The delay in processing your application is solely attributable to this non-cooperation.”
“In view of the above facts, and considering that site inspection is mandatory for deciding such applications, the panchayat body, in its meeting, has unanimously resolved to reject your application for grant of Occupancy Certificate, as the same could not be processed on merits due to denial of access to the property and failure to facilitate inspection,” the panchayat stated.
