Court slams CB for vague comments on anticipatory bail pleas

The District and Sessions Court has slammed the Crime Branch (CB) for submitting vague comments on the anticipatory bail applications filed by Sachin Naik Borkar and Virendra Mardolkar into the food grains scam.

During the hearing on Wednesday, the Court pulled up the CB for its incomplete submission and questioned why the accused are not served notices to join the investigation.

CB's failure to mention the Crime Numbers and Sections of the Indian Law imposed against the two accused was also pointed out by the Court to which, the prosecutor stated CB’s ‘say’ is a reply to the anticipatory bail applications that already contain the case details.  

The prosecution further stated that the accused were involved in similar offenses in the past while appealing to the Court to dismiss the applications. 

In 2012, the CB filed a charge sheet against Naik for a similar offense but he was acquitted. Naik’s legal representative argued that the investigating officers have deliberately not mentioned his client’s acquittal and other specific information about the case. 

The Court, on completing hearing arguments of the accused and the prosecution, has slated the matter for order on December 2.
