Kamal Banerjee, a resident of Goa, was relieved from the department after he failed to report for work after the training period between January to March 1988 in Calcutta. Banerjee stands by his statement that he had submitted a medical certificate issued by an Authorised Medical Attendant .
After filing an appeal with the department, an order was passed in December 2014 saying that Banerjee had “not produced any new facts in support of his request to treat that unauthorised absence period of EOL on Medical Certificate instead of EOL on personal reasons,” further adding that the case was not fit for granting relief, thus rejecting the appeal.
Banerjee since the issuing of the order filed RTIs asking for the medical certificate in possession with the department. Each time however, he has been rejected the information citing Section 24(1) of the RTI, that exempts security and intelligence organisations to divulge information.
Speaking to The Goan, Banerjee has however said, “This is a rather strange situation as all I’ve asked for falls under the employee-employer relationship.” He has filed yet another appeal with the order and is awaiting a date for hearing.
