In a petition before the Bombay High Court at Bombay, his wife Daphne Sequeira argued that
the post mortem which was conducted was not conducted as per Clause (5) of section 176 of the Code of Criminal Procedure.
The high court agreed that according to the aforementioned section
the dead body is required to be forwarded to the nearest civil surgeon or any other medical officer appointed on this behalf by the State Government...
"The dead body was forwarded to the Sassoon Hospital, Pune and not to the Civil Surgeon. We also do not find any material/document to show that the doctors referred above who carried out the post mortem
are specifically appointed by the state government," the court order reads.
Since then, family representatives have informed that the post mortem has been conducted and the verdict reserved pending viscera analysis.
The family representatives have also sought to clarify that he died in judicial custody and not police custody as reported earlier and that his wife Daphne and daughter Martina continue to reside in Goa.
