It was informed that the department is presently awaiting a formal order containing the SC directions.
Speaking to The Goan, Deputy Inspector General of Police Vimal Anand Gupta stated, “As the directions have come from Apex Court, Goa Police naturally looks forward to implement the same. We are well-equipped to undertake this task. However, a formal order has not been circulated as of now. A decision will be adopted on receipt of the same.”
The SC order is expected to be communicated by the Union Ministry of Home Affairs to the State Government, which will then pass it to the Director General of Police for followup action.
“Decision for implementation of the SC directions will be taken after due consideration of the conditions laid down therein concerning non-disclosure of certain sensitive categories,” DIG Gupta said referring to the FIRs exempted by the SC from being uploaded online, such as those pertained to insurgency and sexual cases including those lodged under POCSO Act.
SC has ordered that the decision not to upload an FIR on the website shall not be taken by an officer below the rank of Deputy Superintendent of Police or any person holding an equivalent post.
Commenting on the implementation of the SC directions, Superintendent of Police (North) Umesh Gaonkar said, “Goa Police will follow the decision of its head, the DGP.”
It was, however, hinted that a legal opinion could be sought from the law department or the Advocate General in order to gain clarity on the directions.
SC bench comprising Dipak Misra and C Nagappan on Wednesday issued detailed directions making it mandatory for the States and Union Territories to upload FIRs on their websites within 24 hours of their registration at police stations.
The extension of time to a maximum of 72 hours was granted to States like Mizoram and Sikkim in consideration of network connectivity and geographical terrain.
