Asserting that the government wants to keep him quite and toe the line of the ruling dispensation, Leader of the opposition Babu Kavlekar has submitted that the FIR registered in 2015 has accused the police for corruption and the politician in power and there are no accusations against him in the case.
Arguing on behalf of Babu Kavlekar before the South Goa Sessions court in the anticipatory bail application, senior lawyer, Adv Surendra Desai drew attention of the court that his clien
t has been in the opposition when the FIR was lodged during the BJP rule, adding that Babu was never called for investigations in the case.
Adv Desai said his client is entitled for bail since all the offenses under the Public gambling Act levelled against him are bailable.
"When all the sections are bailable, the police want to arrest my client. In fact, it is the duty of the police to release any person on bail if arrested at the police station," he said, adding "there cannot be custodial interrogation in a bailable case other than for oblique reasons".
Adv Desai further said his client also does not come under the ambit of the Prevention of Corruption Act, saying section 13 of the Act is applicable only to a public servant, who take illegal gratification. "What is the evidence against my client. The complainant, Kashinath Shetye says that the police are involved in corruption," he said, adding that the agency cannot take my liberty except provided by law.
"The Supreme Court has made it clear that the prosecution must establish there was a demand for illegal gratification to attract section 13 of the Prevention of Corruption Act," he said.
Adv Rajiv Gomes, representing Babu's brother, Babal, submitted before the court that the Crime branch is in a confused state of mind, seeking custodial interrogation of the two applicants, when the agency says that the room belongs to Babal.
