HC directs swift action on alleged plot fraud in Salvador do Mundo

The High Court of Bombay at Goa has directed the Administrator of Comunidade (North Goa) to dispose of a long pending show cause notice into the alleged fraudulent allotment of plots in the Village of Salvador do Mundo.   

A show cause notice-cum-order was issued for the Attorney of Comunidade of Serula Peter Martins on December 12, 2022, by the Administrator of Comunidade with regards to the alleged fraud allotment of plots by the Attorney under survey numbers 110/1 (Part) Plot no. 5, 6, 15, 20 of Village Salvador do Mundo.   

The show cause had asked the Attorney why he should not be removed for violating various provisions laid down in the Code of Comunidade and failure to comply with Article 373 of the Code of Comunidade.   

The petitioner submitted to the Court that after issuing the notice, the Administrator was dragging its feet to initiate any action or pass necessary orders in the matter.   

In its order, the Division Bench of Justice Mahesh Sonak and Justice Valmiki Menezes directed the Administrator to take the necessary action to dispose of the notice “in accordance with law and on its own merits within two months.”   

The order also instructs the Administrator to take the necessary action into the allotment of the plots with a fraud Temporary Possession Certificate, while also clarifying it did not go into rival contentions and therefore all contentions of all parties are left open.
