The High Court of Bombay at Goa on Thursday directed the Superintendent of the Central Jail, Colvale, to facilitate the execution of court-mandated undertakings by three members of the Morje family after they were remanded to judicial custody in the advocate assault case.
The Court was informed that Dileep alias Loshan Mangesh Morje and two other members of the Morje family -- son Dhruva and daughter Deepika Tari, earlier in police custody, were being remanded to judicial custody.
Taking note of the development, the Bench directed the Superintendent of Central Jail, Colvale, to facilitate the execution of the required undertakings on the basis of an authenticated copy of its order. The matter has been posted for further hearing on Friday.
Earlier this week, the Bench dismissed the father-son’s petition challenging the arrest and subsequent police remand.
The Bench held that both were informed of the particulars and grounds of their arrest before being produced before the Magistrate. Hence, they were adequately equipped to defend themselves.
The court had also observed that both Morje and his son were alleged to have been members of the same unlawful assembly and to have jointly assaulted the complainant.
According to the complaint, Advocate Ankur Kumar and his client had gone to the site on July 17 in connection with a High Court demolition order when they were allegedly confronted by Morje, his son, his daughter and 8-10 other persons. The complaint alleged that the group restrained their vehicle, damaged it with stones and iron rods and assaulted Kumar and his client.
