In a major relief to Chief Executive Officer of Ola Electric Bhavish Aggarwal, the High Court of Bombay at Goa on Friday quashed bailable warrant and summons ordered by District Consumer Disputes Redressal Commission, South Goa, in a consumer complaint.
Allowing a writ petition filed by Ola Electric Technologies Pvt Ltd and its representative, Justice Amit Jamsandekar held that the Commission had “overreached its jurisdiction” by summoning the CEO when the company was already represented by a lawyer and no personal allegations had been made against him.
A complaint was filed in March 2024 by a South Goa resident seeking a refund of Rs 1.47 lakh and Rs 50,000 as compensation for alleged deficiency in service related to an electric vehicle.
During proceedings on January 20, 2026, the Commission directed Aggarwal to appear in person to clarify the whereabouts of the vehicle, after it was stated that the vehicle given for servicing could not be located. Subsequently, on February 4, 2026, the Commission issued a bailable warrant against him in the amount of Rs 1.47 lakh.
The Bench observed that the complaint pertained to refund and compensation, not recovery of the vehicle, and that the company’s counsel could have addressed factual aspects. It further noted that Aggarwal was not a party to the proceedings and the order violated principles of natural justice.
Terming the Commission’s January 20 order “arbitrary and perverse”, the court set it aside, and consequently quashed the February 4 order issuing the warrant.
