The beleaguered director of Bardez Bazaar Jaywant Naik got temporary relief after the High Court of Bombay at Goa restrained Bardez Bazaar Consumers Cooperative Society from passing any adverse order against him till the matter is heard by the court.
In an interim order on a writ petition filed by Naik, the High Court said Bardez Bazaar may conduct a hearing on the show-cause notice issued to the petitioner but cannot pass a final decision in the matter.
"Bardez Bazaar Consumers Cooperative Society Ltd may proceed with the hearing of the show-cause notice to the extent of accepting a response form the petitioner and conducting a hearing, but will not pass any final decision without further orders of this court," said an order signed by Nutan Sardessai and G S Patel, judges of the High Court of Bombay at Goa.
The High Court has kept the matter for admission on October 4. Moving the High Court, Naik had made the State of Goa, Registrar of Cooperative Societies and all the 11 directors of Bardez Bazaar as respondents in the case.
The High Court has added Bardez Bazaar as one of the respondents. The General Manager of Bardez Bazaar, M/s Yvette D'Souza had issued a show-cause notice to director, Jaywant Naik, on August 17 asking why he should not be disqualified as the director and member of the society.
The belligerent director, Jaywant Naik on Wednesday had hit out at the BoDs of Bardez Bazaar for dancing to the tunes of one person and wanted to eject him as the director and member of the society.
He had said all the motives cited in the show cause were completely false and that he had rebutted the points raised in the notice. He also urged the shareholders of Bardez Bazaar to attend its AGM meeting on September 23.
