MARGAO: The police on Monday sought three days to file a reply in the anticipatory bail plea moved by Quepem MLA and leader of the opposition Babu Kavlekar, even as his brother Babal Kavlekar on Monday knocked the doors of the South Goa Sessions Court for anticipatory bail fearing arrest by the police.
While seeking an undertaking from the Public Prosecutor that Babal will not be arrested by the police till they file reply in the case, South Goa Sessions Judge BP Deshpande posted the hearing in the anticipatory bail plea to September 29.
As far as leader of the opposition is concerned, the sessions court judge further extended the interim bail granted by three more days. When Kavlekar's anticipatory bail plea came up for hearing on Monday noon before Judge Deshpande, Public Prosecutor Ladislav Fernandes moved an application signed by PI Vishwesh Karpe seeking three days for the police to file reply in the anticipatory bail case.
Both the anticipatory bail applications filed by Babu and his brother Babal will now come up for hearing before the Sessions Court on September 29.
In his petition filed before the court by city-based lawyer Adv Rajiv Gomes on Monday morning, Babal stated that he apprehends his arrest by the police under the Prevention of Corruption Act, Goa Gambling Act and under the provisions of the Indian Penal code. "I have been summoned by the police on Monday, but I apprehend that the police will maliciously place me under arrest," he told the court. |
He stated that there is nothing to be recovered or discovered through him, adding that he is ready to cooperate with the agency in any investigation. While stating that he will abide by all the conditions laid down by the court, Babal said there is no likelihood of he absconding from justice since he is a permanent resident of the state and stays with his family. "I am innocent and is sought to be falsely arrested by the police", Babal said, while praying to issue directions to the police to release him on bail in the event of his arrest and to grant him interim bail till the disposal of his anticipatory bail application.
