Additional Sessions Court, Panaji has sentenced a Pilerne youth to rigorous imprisonment for five years while also imposing a fine of Rs 20,000 after convicting him for stabbing his uncle to death with a pair of scissors at their home in Marra, Pilerne in 2015.

Additional Sessions Court, Panaji has sentenced a Pilerne youth to rigorous imprisonment for five years while also imposing a fine of Rs 20,000 after convicting him for stabbing his uncle to death with a pair of scissors at their home in Marra, Pilerne in 2015.
The Court has ordered an amount of Rs 15,000 of the fine amount to be paid to the wife of the deceased as compensation. Based on the evidence brought on record, the court altered the charge of Section 302 (murder) to Section 304 (culpable homicide no

As per the chargesheet filed by Porvorim Police, on April 4, 2015 at their family residence at Pilerne, the 39 year-old uncle attempted to persuade the 17-year-old accused to accompany him to the police station as there was a complaint lodged against the teenager. The accused teenager flew into a violent rage and verbally abused his uncle. He then picked up a pair of scissors lying on a table near the main door and stabbed his uncle on the left side of his chest wounding him mortally. The victim was declared dead upon arrival at the Primary Health Centre, Candolim.
Police attached the blood-stained pair of scissors from near the main door of the house.
Supported by the autopsy report submitted by GMC, the prosecution established that the accused inflicted the mortal injury which caused his uncle's death.
Defence sought to establish that the accused had an unsound mind and that he visited the Institute of Psychiatry and Human Behaviour, Bambolim six months prior to the unfortunate incident. The court refused to admit the plea of insanity as there was no evidence to prove that that the accused was suffering from a certain mental illness at the time of offence.
However, it was observed that there was no motive for committing a murder and that the incident took place at the spur of the moment resulting in alteration of the charge.
