The legal community and citizens from Sanguem and Quepem taluka are currently facing hardship due to new, stringent requirements imposed by the sub-registrar to insert only one name in the sale deeds and other property documents, as it appears only on the PAN card.
The new procedures have been followed for the past 15 days, compelling people and advocates alike to think twice before they execute the sale deeds or such other conveyance deeds.
An advocate from Curchorem informed The Goan that they cannot get documents executed with names as per the PAN card only, as in most cases the names on the survey records and the PAN cards differ significantly.
“This directive presents a considerable hurdle, especially given the historical discrepancies between names on property records and those on PAN cards,” said the advocate.
Previously, property documents were registered based on names provided by the parties involved, without the strict insistence on identity documents now prevalent. This often led to variations in spellings or names recorded in survey records that do not align with current PAN card details, which are typically based on birth certificates.
While parties are generally willing to register documents as per their PAN cards, the core issue arises during the mutation process at the Mamlatdar or Sub-Registrar’s office.
Although sub-registrar officials suggest that a divergence certificate could resolve these discrepancies, obtaining such a certificate is a complex and time-consuming process, requiring verification through birth, school, and marriage certificates.
Furthermore, traditional practice dictates that any name discrepancy between property papers and other documents necessitates a deed of rectification during mutation.
The current insistence by the sub-registrars concerned on recording only a single name, strictly as per the PAN card, will inevitably force parties to execute rectification deeds shortly after the initial sale deed, solely due to these new administrative demands, and through no fault of their own.
