The patient, a 71 year old male was admitted to the hospital with catastrophic brain hemorrhage and was diagnosed to have brain death. Neurophysician Dr Parul Dubey who counseled the family informed them of the imminent fatal outcome as the patient had been put on the ventilator for survival. The family later expressed desire to bring an early closure to the suffering of the patient.
Brain dead patients with ventilatory support can remain in this state of suspended animation for days or even weeks with no hope for recovery.
According to the Act, the state government has to constitute a brain dead declaration panel, with strict rules, certifying the patient as being brain dead. The panel consisted of the hospital’s medical superintendent, the patient’s doctor, a neuro specialist and a senior physician which required them to conduct tests two times six hours apart.
Accordingly, the proper legal procedure for brain death was followed and patient was identified as drain dead at 16:31 hrs on April 16, 2017 and the ventilator was disconnected. Subsequently, patient had cardiac arrest at 17:45 hrs same day. However, after the patient was declared brain dead, unlike the rest of the country, the organ transplant was incomplete.
