The Goa Government’s review plea filed before the Supreme Court of India against the 2018 judgement of the Supreme Court cancelling all mining leases has been listed before the Bench headed by Justice D Y Chandrachud which is also hearing the pleas filed by mining companies seeking that the mining leases be extended with effect from 1987.
Senior counsel Harish Salve mentioned the matter before the Bench of Chief Justice of India who informed him that he granted his consent to list the matter before the bench of Justice Chandrachud.
Review petitions generally need to be filed within one month of the judgement being delivered and before the same bench that delivered the verdict. However Goa’s review petition has been filed more than a year after the verdict was delivered and no since it cannot automatically be taken up by the Bench that was hearing the other mining cases, it required that the Chief Justice of India assign it to a particular Bench.
Earlier the Goa government had sought to mention its review petition before the Bench hearing the petitions filed by the mining companies but was rebuffed since the review petition was not listed before them. It has led to the adjournments of the matter with the latest being until September 9.
