The Ponda police have strongly objected to the plea filed before the High Court of Bombay at Goa by Shrimat Shivananda Saraswati Swami of Kavale Math, seeking the cancellation of an FIR registered against him.
The police, in its submission on Wednesday, contended that he and his accomplice have not been cooperating with the investigation, particularly in providing the Power of Attorney related to the alleged fraudulent sale of property.
Shrimat Swami, Avadhut Shivram Kakodkar and advocate Manohar Adpaikar are booked on charges of impersonation, forgery and fraudulent sale of property in Kavale-Ponda. The FIR was registered based on a complaint filed by surgeon Dr P S Ramani and another person, alleging that Shrimat Swami created fake documents regarding the Math’s property rights.
Following this, Shrimat Swami approached the High Court seeking to quash the FIR. In their reply, the Ponda police further brought to the notice of the Court that the sale deed dated April 13, 2018, appears to have been executed without a resolution from the Trustees with a two-thirds majority.
It also stated that a consent term was executed between the Board of Trustees of Kavale Math and Shree Gurudatt Sansthan, which was accepted by the High Court on March 15, 2007.
As per these consent terms, Kavale Math properties cannot be sold unless a resolution is passed by a two-thirds majority of the total number of Trustees.
The police suspected that the sale deed in question appears to have been executed in violation of these terms.
The police also pointed out that during the investigation, it found that a regular civil suit had been filed in the Court of the Civil Judge, Junior Division “C” Court, Ponda, seeking to declare the sale deed null and void.
The police report mentioned that the accused had stated in the suit that Srimant Satchidananda Saraswati Swami of Kavale Math had passed away on March 3, 2005.
However, the police alleged that false submissions were made before the Court, and the accused did not cooperate with the investigation.
