Referring to a single case of a tender for the ‘Improvement of water supply scheme in Mormugao constituency phase I' the work was sanctioned for Rs 4.78 crore while the administrative approval was granted to the tune of Rs 5.12 crore. When the tender was opened only a single bid was received from one Sheth and Sura Engineering Pvt Ltd for Rs 6.46 crore.
However, in this instance the bid was 40.94% above the estimated cost while the PWD worked out the justified cost to Rs 5.88 crore by m
odifying the quantity and rates of a few items.
However, the Central Public Works Department (CPWD) manual mandates that tenders above five per cent over the justified cost should not be accepted except in peculiar situation and in special circumstances and in these special cases a variation of only up to 10% is allowed.
The negotiating resulted in the bidder reducing his rate from Rs 6.46 crore to Rs 6.23 crore.
While the Goa State Works Board rejected the tender since there was only one bidder, the government directed the PWD to negotiate with the contractor stating that there was an urgency in completion of the work.
In another instance the CAG has found the PWD for using old and substantially higher supply rates for equipment even after the rates had reduced considerably.
"The work was awarded to the contractor at the cost of Rs 6.23 crore which was 36% above the estimated cost of Rs 4.58 crore. This had resulted in acceptance of the single tender at a higher value even after rejection of the tender by the GSWB," the CAG noted in its
