The Central Bureau of Investigations has told the South Goa Sessions Court on Wednesday that the investigating agency will return the seized articles to former MLA Mickky Pacheco in the money laundering case after the acceptance of closure report by the Judicial Magistrate First Class, Margao.
Mickky had knocked the doors of the South Sessions court for the release of documents, hard disk, 2 laptops, 3 mobile phones, file registers, cheque books, diaries, statement of accounts on grounds that he needs these items for his personal need and for contesting the appeal before the Income Tax Commissioner, Panaji.
He had submitted to the court that he will be in great difficulty if the documents are not released and the he will be in great loss.
In this regard, the CBI has submitted to the Session court on Wednesday that a closure report under section 173 of the Cr P C has been filed by the investigating agency before the Judicial Magistrate First Class, Margao and the same is pending consideration before the court of JMFC, Pooja Desai.
"The seized articles may only be returned by the CBI to the accused after acceptance of closure report by the Court," the CBI Superintendent Anil Singh said in his reply.
Mickky's lawyer, Adv Byron Rodrigues said that the former MLA has submitted before the sessions court that no case of cheating or forgery has been made out against him and that he has been wrongly harassed by false and frivolous complaint.
