The Judicial Magistrate First Class has ordered the registration of an FIR against the former attorney of the Tivim Comunidade Savio Pereira for allegedly committing offence under sections 403, 406, 417 and 420 of the Indian Penal Code.
A group of members of the Tivim Comunidade including Joseph Souza, Braz de Souza, Antonio Fonseca, Mathew Pereira, Eddy de Souza, Domnic D’Souza, Orland Estrocio, Anthony Fonseca and Gasper Fonseca had filed a complaint against Pereira for allegedly accepting Rs 15.50 lakh from one Zacrias Victor D’Souza -- representing property owners Keith Lewis and Gertie Lewis and illegally granting easement road access to their property through land belonging to the Tivim Comunidade without following proper procedure.
However, despite filing the complaint with the police, no FIR was registered.
“It is seen that no action has been taken inspite of several requests of the applicant. All the facts reveal that the concerned police officer did not register a FIR inspite of the commission of a cognizable offence for reasons best known to him.
"The material on record reveals that a cognizable offence has been committed and no proper investigation or rather no investigation has been carried out and therefore I am of the opinion that the present needs to be allowed… the concerned investigating officer is directed to register the FIR and to act accordingly… within a period of 30 days from the date of the order,” the JMFC Anuradha Andrade said.
