Siolim Five Pillars Church pastor Domnic and his wife Joan withdrew their petitions challenging the notices for externment issued by the North Goa Collector with liberty to approach the Court should an adverse order be passed against him.
Dominic and Joan had challenged a show cause notice issued under Sections 3 and 4 of the Goa Maintenance of Public Order And Safety Act, 1988 requiring the petitioners to show cause as to why they should not be externed from North Goa District.
However, with the High Court not inclined to entertain the petition at a premature stage, the duo withdrew the petitions “with liberty to respond to the show cause notice and raise all permissible defences and grounds, including the grounds raised in these petitions.”
“All contentions of all parties are left open to be decided by the externing Authority in the first instance. All remedies of the petitioners, in case they should suffer any adverse orders, are also left intact,” the High Court said granting the duo liberty to challenge any adverse order in accordance with law in case any externment orders are passed.
