a) State government should not permit dump handling
b) Royalty is payable on any material removed from dumps
c) Proper environmental clearances are a pre-requisite fordump removal/mining
d) In respect of removal/handling of dumps outside the leasearea any policy decision needs prior approval of the ministry of mines
Internalnote for CM’s approval
a) In the garbof commenting IBM is indirectly issuing directives to the state government inareas which are the exclusive domain of the state government
b) Stategovernment is fully aware of provision in mining and under MMRDA Act 1957 andMCDR rules 1988 and we do not need any direction from IBM in discharging ourobligation
c) No fresh environmentalclearance is required for dump handling. This is covered under the EC grantedfor mining
d) Handling ofdumps does not require fresh clearance or approval s bring claimed by IBM. Thewhole process is fully covered under the mining plan and it would amount toharassment if IBM wants state government or lease holder to seek fresh permissionin this regard.
