The South Goa Sessions Court has reserved its order to September 11 in respect of the anticipatory bail application field by Malcolm Pereira in the alleged assault on Chinchinim Sarpanch and Aam Admi Party leader Gerson Gomes.
The Cuncolim police has strongly objected to the bail plea field by the applicant, while the applicant’s lawyer Adv Amay Prabhudesai submitted to the Court for grant of the anticipatory bail application. Adv. Prabhudesai drew attention of the Court that the applicant has been cooperating with the investigating agency in respect to the assault case.
Adv Stanley D’Costa, representing Sarpanch Gerson, argued before the court for the dismissal of Malcolm’s anticipatory bail application. Adv Stanley tried to impress upon the Court that the attack on Gerson is not just an attack on a Sarpanch but an attack on the Authority of the state itself.
He submitted before the Court that a Sarpanch, who is a public servant gets the authority from the State and is given protection to discharge their duties as per section 121(1) of the BNS.
He also submitted before the Court the chain of events that finally resulted in the assault on the Chinchinim Sarpanch.
The Court’s attention was also drawn to the appearance of Malcolm at the Cuncolim police station on Wednesday morning when he was told to join in the investigations in the evening.
