Addressing the media, CVSWF President, Wauswell Miranda said the Forum has challenged the notification containing the Amendments made to the Goa Land Development and Building Constructions Regulations of 2010 read with the Goa Land Development and Building Construction Act of 2008. “The Forum has challenged the “fraudulent” amendments by filing the PIL seeking to quash unlawful Amendments to the Building Regulations relied upon by the Rahejas to get technical clearance for their projects in the village of Carmona,” he added.
A villager Succor Miranda said the 2011 Amendment to the Goa Land Development and Building Constructions Regulations of 2010 has benefited the Rahejas in Carmona. “The Amendment was intended to ensure that the Mumbai real estate developer enters Carmona,” he said, while calling upon the people of Goa and the social activists to brace up for a battle against the illegal Amendment.
The Forum has pointed out that there are no records in the Legislative Assembly suggesting that the Amendment was passed in the House, raising questions how the Amendment was published in the official gazette when it was not passed by the Assembly. “Information sought under the RTI from the Assembly has revealed that no amendment to the Goa Land Development and Building Constructions Regulations of 2010 was passed by the Assembly,” Forum members pointed out, while demanding to know how a so-called Amendment is figuring in the notification when it was not done so by the government.
Joaozinho da S F A Martins explained that with the “fraudulent” Amendment published in 2011, the earlier mandatory and essential 10-metre wide right of away (access road) to any multi-dwelling housing construction site has been subtly done away with, making it easy for the builders to get technical clearances, unlawfully.
“Subtle change has been illegally made in Regulation 6 A 4 of the said Act through the insertion of Note 16. This “illegal” note allows technical clearances to be easily given even when there are obstructions”, he said, adding “as such, development plans for multi-dwelling housing projects can be easily approved for even less than three meter wide access road and that too with bottle necks and other obstructions and irrespective of the nuisance caused to traffic due to narrow road.
