Karbotkar has been booked for murder, causing disappearance of evidence and hurting a public servant to deter him from duty. Crime Branch has listed 40 witnesses in its chargesheet and has included magisterial statements of 10 witnesses. CCTV footage where the commission of crime has been recorded has also been submitted as a prime piece of evidence.
Bengre, the notorious gangster from Betim was allegedly stabbed to death by Vinayak Karbotkar, a prisoner under trial at the Central Jail in Colvale on July 26.
Jail’s CCTV footage acquired by the investigating team from Crime Branch shows Karbotkar indulging the deceased in a conversation outside his cell while showing him some newspapers. While Bengre was busy reading the paper, Karbotkar moved behind him from the left and stabbed him in his neck.
“The accused over previous enmity and to overpower the supremacy of the deceased Bengre in Central Colvale Jail intentionally and with a malice stabbed the under trial inmate Bengre with a knife at various parts of his body resulting in his death,” reads the chargesheet adding that Karbotkar also caused disappearance of evidence.
The investigating agency has submitted that, despite making all efforts, the weapon -- a knife couldn’t be recovered. The clothes worn by Karbotkar during the commission of the crime have also not been located.
The post mortem examination report stated that there were six stab injuries, five incised injuries, one point abrasion and one grazed abrasiom over Bengre’s body. The report also held that the cause of death was hemorrhage and shock as the injury passed through right side neck causing transection of right side carotid artery caused by the sharp, pointed, cutting weapon, and was necessarily fatal.
Investigation has also revealed the negligence approach of the Central Jail, Colvale staff as Karbotkar was let free after the commission of offence and he was allowed to proceeds towards the mess by leaving the under trial block. “He was not isolated and thereafter kept in the cell along with more than 47 other inmates which facilitated him to conceal the clothes and the knife,” states the charge sheet.
The charge sheet further states that Karbotkar also assaulted Satish Naik, guard of the jail with a knife as he tried to rescue Bengre. Naik sustained injuries on his check.
According to Naik’s statement, he was on duty on July 26 and at about 8.50 am, he opened Bengre’s cell.
But when he was gathering other under trials from their cells, he suddenly heard screams from the open corridor near cell no 9.
He then saw that Karbotkar was assaulting Bengre with a small knife. He went over to them in an attempt to separate them and in the process sustained injuries on his cheek.
Crime Branch has secured statements of several eye witnesses and the chargesheet has confirmed that upon fatally assaulting Bengre, Karbotkar proudly informed the witnesses that he has killed Bengre.
