The South Goa Sessions court on Tuesday granted anticipatory bail to Mohammed Javed Kunji who had knocked on the doors of the court fearing arrest in a cheating case registered against one Jalees Jailani.
While granting the anticipatory bail, Additional Sessions Judge Vincent D’Silva has ordered the release of the applicant on bail of Rs 30,000 with one surety in the event of arrest.
The court further directed the applicant not to interfere, threaten or otherwise intimidate the complainant and his family members, in any way and not to influence or tamper with evidence.
The applicant was further directed to report to the Investigating Officer at Fatorda Police Station for seven days from Wednesday between 10 am to 1 pm and shall co-operate with the investigation. The applicant was told not to leave the country without the permission of the court and shall furnish his residential address with proof and contact details.
“Admittedly, the accused namely Jalees Jailani has been already released on bail by JMFC, Margao on the execution of personal bond of Rs 30,000 with one surety in the like amount on October 4, 2022. The presence of the applicant is not required for any custodial interrogation and the same can be taken care of by directing the applicant to attend the police station and imposing other conditions,” Judge Vincent observed.
Pointing out that the applicant is a permanent resident of Margao, the Judge further said there is no possibility of the applicant fleeing from justice, being a resident of Margao, adding that the applicant, therefore, deserves to be enlarged on anticipatory bail, with conditions.
