The city-market complex at the periphery of the Mapusa town is back in the focus after the Administrator of Comunidades, North issued a show-cause notice to the owner asking why action should not be initiated against the alleged illegal construction.
At least 40 stalls and sheds for restaurant and ice cream parlour have been constructed in the city-market complex on comunidade land near the Carvalho Petrol Pump in the jurisdiction of Mapusa municipality.
Acting on a complaint of the Mamlatdar of Bardez, the Administrator of Comunidades, North, Shivprasad Naik has issued a notice to the owner Atmaram Gadekar for carrying out the alleged illegal construction in the property belonging to Mapusa comunidade.
“As per the complaint, it appears the activity of illegal construction has been carried out in PT Sheet No 162 chalta no 5/1 of Mapusa belonging to the comunidade of Mapusa without any authority/permission. You are directed to show-cause why action shall not be initiated against the said illegal construction of kiosk,” Naik said.
The notice also states that one Sushant Fatarpekar has allegedly given a false report in PT Sheet No 162 chalta no 5/1 of Mapusa city.
Interestingly, former deputy CM Dayanand Narvekar in a signed affidavit cum no objection certificate had claimed that he is the deemed owner of the property known as “Pivotes de Bombarxet Com as de Cham Cungo” situated near Carvalho Petrol Pump in property bearing PT Sheet No 162 chalta no 5/1 of Mapusa city.
He also gave the NOC to Atmaram Gadekar to erect a shed in the property for commercial purpose.
“I do not have any objection for him (Atmaram Gadekar) to avail necessary licence/permission/NOCs/approval in his name,” Narvekar said in the affidavit.
The executive members of the comunidade of Mapusa admitted that the land where the alleged illegal mini-market has been set up belongs to comunidade which has been tenanted.
“If someone is deemed owner of the comunidade land then he cannot carry out commercial activity in the land. It’s agricultural land. He can cultivate it. The construction is completely illegal,” a senior executive member of Mapusa comunidade said.
MMC had ordered sealing of premises but…
MAPUSA: Two years ago, the Mapusa Municipal Council (MMC) had issued a show-cause notice to the city-market and even ordered sealing of the premises, but it was subsequently re-opened for reasons best known to the civic administration.
The technical section of the MMC had conducted an inspection of the property and found that the stalls and sheds were constructed illegally without obtaining permission of the council under Section 184 of Goa Municipalities Act, 1968.
The municipal engineer in his report had said that the transgressor Atmaram Gadekar a resident of Canca has constructed 40 stalls besides sheds for restaurant and ice cream parlour in chalta no 5/1 near Carvalho Petrol Pump in Mapusa.
The report had also mentioned that the entire construction was done illegally without obtaining permission of the council as required by the law.
“We had sealed the premises, but the owner appealed to the director of municipal administration and managed to reopen the place,” a civic official in the know informed.
