In response, Khan in a statement from London, where she currently is has said that the complaint is only a counterclaim to the arbitration proceedings she has filed against the Emgee Group to recover her dues. “The said complaint is motivated and preposterous and has been filed only to intimidate me and pressurise me to withdraw the arbitration proceedings which has been initiated by me in the first instance to recover my dues and damages resulting from breach of contract,” Khan said in a statement. Naira is a 12 designer villa project including courtyards and swimming pools along the slopes of Siridao that claims itself to be 120m from the sea with “sea in the front and forest behind.” Mudhit Gupta of Emgee group, in his complaint to the police, said that he had engaged Khan as an architect and designer for the project but that she failed to deliver the project in time, as stipulated in his contract. However, later Gupta found that Khan s work was not to his satisfaction and on probing further he later realised that Khan wasn t registered with the council of architecture and hence he filed the complaint. Speaking to The Goan, Panaji Police Inspector Siddhanth Shirodkar said that they registered the case only after an initial inquiry during which time the complainant approached the JMFC to register the case. “They had approached the police with a petition to file a case, which was being inquired into.” “The case was filed around 11 days back after it was found that it required a FIR to be filed,” PI Siddhanth Shirodkar told The Goan. Despite claiming that the work is substandard, the conceptual drawings on the project are the same on both the websites -- of Emgee Group and The Charcoal Project -- Khan s company. Khan said she had challenged the termination of the contract with Emgee Enterprises and has invoked arbitration under the contract for recovery of her dues and hence “as a counter-blast to the said proceedings, Mudhit Gupta, only with the intention to harass and pressurise me to give in to his frivolous counterclaim, initiated the criminal complaint.”
