The South Goa Sessions Court has dismissed the anticipatory bail plea of Binish Thomas, a resident of Bengaluru-Karnataka, who was wanted by the Fatorda police in connection with the 2021 case of alleged cheating.
While dismissing the anticipatory bail plea, Additional Sessions Judge, Vincent D’Silva has said the materials on record clearly indicate that the applicant induced the intervenor to pay an amount of Rs 48 lakh on different occasions by cash and bank transactions on the pretext of providing a medical seat to his daughter in Fr Muller Medical College, Mangalore. The applicant, however, failed to provide a medical seat or return the said amount to the complainant and thereby, dishonestly cheated him of the said amount.
The Judge said the applicant has been evading arrest ever since the offence has been registered against him. “The applicant is also a habitual offender as seen above. The investigation of this case is in the preliminary stage. Crime committed by the accused person is serious in nature as the applicant has cheated a gullible and unwary parent, who was foreseeing a bright future for his daughter, whose dream the applicant shattered into pieces for both the parent and the daughter.”
The Judge added: “The said amount to the tune of Rs 48,00,000 is a huge amount, which records show was partly borrowed and partly raised by selling the gold ornaments of the family members and therefore, the presence of the applicant is required for the purpose of investigation in order to find out any person involved in the said crime and also to find out as to how many people were cheated or where the money were kept or in which medical college he has deposited.”
