MARGAO
A civil court in Margao has directed the court receivers managing the affairs of Sociedade Agricola dos Gaocares de Cuncolim e Veroda to conduct election of the society within a period of three months.
Granting an application moved by a group of petitioners including Shaba Rama Desai, Tony Rebello, Manoj Sapre and Victor Norohna, civil judge Puja Sardesai directed the court receivers Adv Mario Almeida and Adv Tarshish Pereira to conduct the election as per the law and after publishing the notice of the meeting in two widely circulated newspapers. The judge further directed that the notice of election is also to be displayed on the notice board of the society.
In her order, Judge Sardesai said that it is not in dispute that the tenure of the Sociedade has expired on
May 31, 2014.
"It is further not in dispute that the court receiver has been appointed to protect the interest of the Sociedade. As the tenure has already expired, it would be just and proper to direct the court receiver to conduct the elections by following the procedure in accordance with the law," the judge said.
By order dated October 31, 2017, the court had brought in temporary injunction and restrained the defendants from carrying out any activity of whatsoever nature till the final disposal of the case.
