A Special Court has completed the hearing on the anticipatory bail application of the Leader of Opposition Chandrakant Kavlekar and reserved its order on the plea till October 5 in connection with a case of disproportionate assets filed against him by the anti-corruption bureau (ACB).
On September 15, 2017, the Anti-Corruption Branch had registered a first information report (FIR) against Kavlekar for having more assets than his source of income under Section 13 (2) read with 13 (1) (e) of Prevention of Corruption Act, 1988.
The case against him was filed in the year 2012.
The ACB had conducted preliminary inquiry and referred the report to the state government in the year 2013. Chief Secretary Dharmendra Sharma gave his assent to file FIR in the year 2017.
Kavlekar had filed an anticipatory bail application before the special court after the anti-corruption bureau had summoned him for interrogation.
Kavlekar’s lawyer has submitted that he had obtained loan from Mumbai-based Akshit Exports amounting to Rs 1,70,00,000, an amount of Rs 3,00,00,000 from Vibha Star and from Prime Star a sum of Rs 80,00,000.
The ACB had alleged that during the period from January 1, 2007 to April 30, 2013, Kavlekar had acquired assets worth Rs 11,98,85,910.
After subtracting the savings, ACB found disproportionate assets amounting to Rs 4,78,58,471 which is 59.21 percent above the known sources of income during the period.
The prosecution lawyer contended that the loan of Rs 5.5 crore is questionable and could go towards increasing the disproportionate asset percentage substantially.
