The South Goa Sessions Court has granted conditional bail to Sidhesh Sanjeev Halgekar, who was arrested by the police in a drugs case.
While granting bail, Additional Sessions Judge, Vincent D’Silva directed the applicant to execute personal bond of Rs 50,000 with two local sureties in the amount of Rs 25,000 each.
Judge D’Silva directed the applicant to report to the Investigation Officer on every Monday between 10 am to 12 noon till filing of the charge sheet and to cooperate with the investigation.
While issuing directions not to tamper with the evidence or influence the witnesses, the applicant has been further directed not to leave the State of Goa without the prior permission of the Court and shall deposit his Passport before the Court, forthwith.
Failure of the applicant to abide by the above conditions will entail the prosecution to apply for cancellation of bail, the Judge ordered.
The applicant was allegedly found in possession of a blue colour polythene bag, containing in it greenish colour flowering and fruiting tops of a plant suspected to be narcotic drugs ganja weighing 1.100 kgs. worth Rs 1,10,000 approximately in international market, cash of Rs 18,380 along with one Maruti Suzuki Baleno car bearing no. GA-08-N-8667 which were attached under search and seizure panchanama.
While granting bail, Judge Vincent observed that the quantity of contraband found with the applicant was variable, and therefore, the rigours of Section 437 of CrPC and Section 37 of the NDPS Act cannot be invoked to deny the bail to the accused.
