Ex-Anti-Narcotics Cell cops to face trial in drugs case

Charges to be framed for fabricating case against Dudu

Former Anti-Narcotics Cell (ANC) cops, charged with fabricating a case of drugs on Israeli national David Driham alias Dudu, will face criminal trial as the Additional Sessions Judge, Mapusa is set to frame charges against them on Monday.

Then DySP Naresh Mhamal, PSI Sunil Guddlar, and five constables will undergo trial under sections 192 (fabricating false evidence) reads with 195 (giving or fabricating false evidence with intent to procure conviction of offense), 203 (giving false information respecting an offense committed), 211 (false charge of offense made with intent to injure), 506(ii) (criminal intimidation) and 195 IPC for making false statement against Dudu, and under Section 20(b)(ii)(c), 21(a)(b) and 22(c) of NDPS Act.

The matter pertains to a raid by this ex-ANC team in February 2010 wherein the FIR accused Dudu of carrying multiple commercial quantities of drugs in Anjuna. The Central Bureau of Investigation (CBI), which on re-investigating the case filed a supplementary charge sheet suggesting that Dudu was implicated in the false case by the seven policemen.

Not only Gudlar is suspected to have tampered with the seized drugs in ANC Malkhana, but he also lied about using an office typewriter to prepare a note for CFSL, Hyderabad. The constables, on the other hand, mislead the CBI.

“Gudlar prepared a forwarding note of the seizure contraband to CFSL, Hyderabad on the spot using Office typewriter which is not the correct position as he had not done so. Accordingly, psychoanalysis test was done of five police constables Euarmia Guraya, Mahadev Naik, Mahableshwar Sawant, Nagesh Parsekar, Sameer Varkhandkar, and accused no.1 (Dudu) … report suggests that these five police constables are deceptive in their statements. However, the statement of Dudu appears to be truthful,” reads the order that quoted CBI’s findings.

Moreover, the seals of many exhibits in the ANC Malkhana were tampered as opined by the CFSL report and a large quantity of drugs like Charas, Heroin and Cocaine were found deficient in the exhibit sent for examination. Gudlar was also the in-charge of the ANC Malkhana.
