The State Government on Wednesday admitted before the Bombay High Court at Goa that the externment order of the District Authorities issued against Tukaram alias Manoj Parab, a member of the Revolutionary Goans, was without jurisdiction and would be withdrawn.
Parab had challenged the externment notice issued to him, but when the matter came up for hearing, Public Prosecutor SG Bhobe made a statement before the Division Bench of the Bombay High Court at Goa comprising of Justice MS Sonak and Justice Bharati Dangre, that the notice issued was not tenable and was being withdrawn and that proper course of action would be followed.
“The Court accepted the statement that the notice was withdrawn with liberty to take appropriate action as per law. The Petition challenged the very notice of externment on ground of jurisdiction viz the Awalkarkaun in Office of District Magistrate (North Goa) Priya Parab, had no authority nor jurisdiction under the law, to issue the Show Cause Notice,” Adv Carlos Alvares Ferreira said.
The order is the latest in a series of legal victories that Parab has secured against orders issued against him by District Authorities all of which were prohibitive in nature.
