HC quashes FIR against Ex-Gomantak Bhandari Samaj President

PANAJI

The High Court of Bombay at Goa on Monday quashed the FIR against the former President of Gomantak Bhandari Samaj, Ashok Naik, and other ex-members of the committee in connection with the alleged misappropriation of funds.

The FIR, registered on May 31, 2023, accused Naik and others of misusing funds and committing a breach of trust by opening a bank account in the name of Gomantak Bhandari Samaj and withdrawing large sums of money, despite the organisation being an unregistered society.

Following the FIR, the accused approached the High Court, arguing that the complaint was based on incorrect facts and was politically motivated. The petitioners clarified that Gomantak Bhandari Samaj is a registered society under number 282/GOA/2015, as per the Societies Registration Act, 1860.

They further contended that the complaint was a misuse of the legal process and did not establish any cognisable offence. They also pointed out that the complainants failed to provide any evidence of fund misappropriation.

After hearing the matter, the High Court quashed the FIR against Naik and four others.
