The High Court of Bombay at Goa has restored a criminal writ petition that was earlier dismissed for failure to remove office objections, while pulling up the petitioners for their casual approach in prosecuting the matter. The Bench of Justice Amit Jamsandekar has also imposed Rs 5,000 costs to be sent to the Goa Police Welfare Society.
The Bench allowed the restoration application filed by petitioners Shankar Phadte and another, reviving a Criminal Writ Petition after accepting their explanation that the office objections remained unattended due to inadvertence.
The Court noted that the writ petition was dismissed on June 17 after the petitioners failed to comply with directions to remove office objections despite being granted sufficient opportunities, including a final chance by the Court. It observed that the record reflected a ‘casual approach’ on the part of the petitioners in pursuing the proceedings.
Allowing the application, the Court directed the petitioner to remove all office objections within two days and deposit Rs 5,000 with the Goa Police Welfare Society within the same period.
