The South Goa Sessions Court on Tuesday convicted and sentenced a Kenyan National Micah Gumbi to 10 years rigorous imprisonment and a fine of Rs 1 lakh under Section 22 (c) of the NDPS Act.
In the default of the payment of fine, Principal Sessions Judge Sherin Paul has ordered the accused to undergo further imprisonment for a period of two years.
Public Prosecutor V G Costa informed that the accused is further sentenced to rigorous imprisonment for a period of five years and fine of Rs 50,000 for being in possession of cocaine and in default of the payment of fine, the accused is to undergo further imprisonment for a period of one year.
Costa informed that the accused has been further directed to undergo rigorous imprisonment for a period of five years and pay fine of Rs 50,000 for being in possession of MDMA and in default of the payment of fine, the accused is to undergo further imprisonment for a period of one year.
All the substantive sentences of imprisonment and the imprisonments in default of payment of fine are to run concurrently, he added.
The period of detention undergone by the accused during the investigation and trial, that is, from December 31, 2017 till date shall be set off in terms of Section 428 of the Code of Criminal Procedure.
In this case, the accused was found in possession of drugs on December 30-31, 2017 at the Parking lot of Pallolem beach, Canacona.
Acting upon the specific and reliable information, a narcotic raid was conducted and the accused person was found in an illegal possession of narcotic substance, i.e Cocaine weighing 10.49grams, worth Rs 60,000; Two perforated sheets i.e LSD weighing 0.33miligram, worth Rs 80,000 and 20 number of Ecstacy tablets weighing 05.52grams, worth Rs one lakh. The total value of the drugs were pegged around Rs 2.40 lakh. The police had also attached a mobile phone, internet modem, wallet containing cash of Rs. 2,200/- and wrist watch from the possession of the accused.
