The Bombay High Court at Goa has granted permission for the promoters of casino vessel M V Lucky Seven
to have the beleaguered
boat towed to a dockyard in Dubai instead of Jaigarh in Maharashtra where it was originally scheduled to be transported.
Disposing off a miscellaneous civil application filed by Golden Globe Hotels, the High Court, after seeking the opinion of the Advocate General permitted the vessel to leave the Mandovi.
"The petitioner is permitted to take the vessel namely MV Lucky Seven to Dubai for repairs instead of Jaigarh Port subject to necessary permission, if any being obtained from the competent authority," the High Court said in an interim order.
Golden Globe Hotels had approached the High Court seeking permission to tow the vessel MV Lucky Seven to Dubai instead of the dry dock at Jaigarh (Ratnagiri) as the Jaigarh Port has no facility which can accommodate the vessel.
The promoters had also sought that the government be directed to give all necessary permissions to enable the vessel to be towed to Dubai and re-enter at Verem Anchorage after all necessary repairs and obtaining appropriate permission about the seaworthiness of the vessel. It is submitted that the vessel was to be moved out within one week.
However, with regards to the second plea, the Advocate General opined that it would be better if it is decided by a regular bench, instead of a vacation bench which is currently in place in view of the ongoing Diwali vacation.
