A Mapusa court has slated for order on March 13 on whether an FIR can be filed in the alleged poll violation case in the State against Delhi Chief Minister, Arvind Kejriwal.
As directed by the court, the SDM and the then Returning officer, Gurudas Dessai appeared before the Judicial Magistrate First Class on Thursday and requested the court to direct police to register an FIR against the Delhi CM based on his complaint.
The court has asked the complainant to submit a CD containing the video of the alleged controversial speech of the Delhi CM.
The more-than-a-year-old case was registered as a non-cognisable offence at the Mapusa police station, following a complaint by the then RO against Kejriwal for his bribery comments made at an election campaign rally in Goa.
Kejriwal in his election campaign speech had exhorted the Goa voters to accept money offered by other political parties but to vote only for AAP.
After nearly a year, the state election officials approached the Mapusa court in December 2017 to issue directions to police to register the offence as FIR under sections 171 B (inducement) and 171 E (bribery) of the IPC.
Assistant Public Prosecutor Sukesh Talavnekar said that the complainant, Gurudas Dessai has filed an application before the JMFC, Mapusa seeking directions from the court to police to conduct the investigations and submit a report in the case.
“The court has taken the application on record and fixed the matter for orders on March 13,” Talavnekar said.
