MMC CO orders razing of structure on KTC property

MARGAO

Margao Municipal Council Chief Officer Agnelo Fernandes has ordered the demolition of the structure that has been erected on the property of the Kadamba Transport Corporation, Margao within 15 days.

The Chief Officer’s order further stated that the MMC would demolish the structure in the event it is not razed, and recover the cost as part of the House tax arrears.

During the hearings, the KTC Margao depot had filed their reply stating that they have allotted the space to the Respondent being the successful bidder, and as per clause no 2 point no 6 of the general condition and construction of the Expression of Interest (EOI) and also their letter dated January 7, 2021, the successful bidder is required to obtain all the permission needed for the erection and operation from the respective authority. There is also no permission from the SGPDA.

The order stated that Respondent No 2 did not produce any such permission neither from SGPDA nor the municipality.

“I have to construe that Respondent No 2 failed to produce any documentary evidence proving that the structure in question is either approved by the SGPDA and or permitted by the Municipal Council as such it is proved beyond doubt that the same is unauthorized and illegal. Therefore it attracts action under Section 184(8) of Goa Municipalities Act 1968”, Agnelo stated.

The Chief Officer also held the contention of the Goa Civic and Consumer Action Network valid that construction of the illegal structure is in the area allocated for two-wheelers and is close to the footpath of the main road heading to the roundabout, and that the location is very dangerous as it will hugely affect the traffic flow on the main road and many customers will park their vehicles on the main road and visit the stall.
