MUCB says defaulters’ list cannot be made public

The Madgaum Urban Cooperative Bank has asserted that the request to hand over the list of defaulters and other details cannot be furnished as per the legal advice obtained by the bank.  

In a letter to shareholder Dionisio Sardinha, MUCB Managing Director, Kishore S Amonkar further said that it is not correct on the part of the shareholder to apprehend that the Managing Committee is not furnishing the names of defaulters in order to save some people, who are in good books with the managing committee.   

Narvekar pointed out that after the shareholders demanded the detailed list of defaulters of the bank at the annual general meeting, it was decided to call for a legal opinion on the matter to ascertain if the bank can furnish customer information to the public.   

“The legal advisor advised the bank against making any customer information public and accordingly the management decided that the bank shall not divulge any customer information in public domain,” the letter stated.  

The MUCB Managing Director further asserted that under section 32 of the Goa Cooperative Societies Act, 2001, the right of members is to see books and records relevant to his/her transactions with the society.  

He further told Sardinha that the adjourned meeting could not be held on January 10 as there was a potential of violating the Covid-19 pandemic norms as prescribed by the Ministry of Home Affairs, which mandated that the number of persons allowed should be only half of the capacity in the closed premises. 

“The capacity of the premises is 200 and at the adjourned meeting, there were 107 persons attending the meeting, besides the BOD team and organizing committee members,” Narvekar told the shareholder in his letter.
