In an interesting development, the South Goa Sessions Court on Tuesday issued notice to complainant Hazrat Ali Sheikh alias Anwar Sheikh in the Fatorda attempt to murder case to remain present in court as trial in the matter is set to commence from August 31.
Though reports coming from Karnataka spoke about the brutal murder of Anwar Sheikh earlier this month, sources said it is now for the prosecution and the Fatorda police to submit before the court documentary proof that the complainant has expired.
As reported earlier, the death of the complainant does not prove fatal to the case and the trial will continue in the matter with the examination of other witnesses.
Notice to Hazrat Ali Sheikh alias Sheikh Anwar was issued by South Goa Additional Judge, Vincent D’Silva, on Tuesday as he framed the charges against the six accused persons in the attempt to murder case, setting in process the trial of the matter in the absence of the complainant, who was murdered recently in Karnataka.
Besides Anwar Sheikh, the court has also issued notices to three more witnesses, including the investigation officer and two panch witnesses, to appear in the court on August 31.
The six accused persons, who will face trial in the court, include Ricky Hornekar (28 ) Pontemol, Curchorem, Imran Bepari, (32) St Cruz, Kalaphur, Tiswadi, Harshavardhan Sawal, (37) Waiginwada, Bardez, Sudan Da Costa, (40) Seraulim and Vasant @ Amir Gavande, (38) Near Peace Valley, Shirvoi, Quepem and Vally George Da Costa,(31) Tilamol, Quepem.
Vijay Karbotkar, (31) Coelho wado, Brittona, Bardez and Mahendra Tanawde (37), 20 Point Program, Porvorim, have been discharged in the case.
While all the six accused persons have been charged under sections 143, 147, 148, 307 and 120-B r/w 149 IPC, accused Vally will face charges under the Arms Act.
Meanwhile, Judge Vincent D’Silva on Tuesday granted bail to accused Ricky Hornekar, who was ordered to be released on a personal bond of Rs 25,000 with one surety in like amount. The Court directed the accused not to influence the witnesses or tamper with the evidence.
Amongst other conditions, the judge directed that the accused not to leave Goa without the permission of the court furnish his residential address.
In his bail order, the judge said the State has already filed the chargesheet and no further investigation is required in the present case. The court observed that the accused was last involved in Curchorem Police Station Crime No.23/18, under Sections 147, 148, 326 r/w 149 IPC, two Chapter Cases and one NC case, all in the year 2018.
“No other offence has been reported except the present offence. The accused is having roots in the society. No purpose would be served by detaining the accused further in the custody and therefore he deserves to be enlarged on bail with conditions,” the judge said.
Meanwhile, accused Vally has also moved the South Goa Sessions court for bail.
