Goa Speaker Pramod Sawant on Wednesday junked the notice given by Opposition Leader Chandrakant Kavlekar and 15 other Congress MLAs seeking to move a motion for his own removal, citing rules of procedure of the House as well as provisions of the Constitution.
The notice was not maintainable as notices of the type needed to be given when the session is on and with at least 14-days prior intimation, a statement issued by the Speaker’s Office said. The Statement said, the Governor has currently not summoned the session which can be done only after six months from the last day of the immediate past session.
“Therefore the Speaker has advised the Legislature Secretary to communicate to the Leader of the Opposition that the said notice has been disallowed on the grounds of maintainability,” the statement issued by Atmaram Bharve, the private secretary to the Speaker, said.
Bharve also said in the statement that the Speaker’s action was following the opinion of the Advocate General who perused the Rules of Procedure and Conduct of Business of Goa Legislative Assembly, as well as the Constitution of India, before submitting his advice to the Speaker’s Office.
“The Congress Legislature Party will meet after official word is received from the Legislature Secretariat and we will collectively decide the next course of action,” Kavlekar said.
Kavlekar and all the Congress MLAs had served the notice under Rule 243 of the Rules of Procedure and Conduct of Business of the Goa Legislative Assembly, read with Article 179(C) of the Constitution of India, on September 21 during the political turmoil triggered by the air-lifting of the ailing Chief Minister Manohar Parrikar to the All India Institute of Medical Sciences, Delhi.
