Sessions Court, Panaji on Thursday discharged Cruz D’Costa (27), resident of Nuvem, in a case of murder registered at Agassaim police station in November 2015.

According to the charge sheet filed by Agassaim Police, on November 8, 2015 at Pilar junction, the accused assaulted Betty D’Souza from Agassaim with punches and kicks thereby causing grievous head injuries which resulted in his death.

However, the post mortem report of GMC ruled out assault as the cause of the head injury. Instead, it stated that the head injury was a consequence of blunt force impact by surface or object.

Sources revealed that the deceased and the accused were known to each other and had met with an accident on the fateful day.

D’Costa was arrested by the Agassaim Police in connection with the offence on November 10, 2015 and was released on bail on January 16, 2016 after having spent more than two months in custody.

Defence counsel Adv Savio Noronha argued that there is absolutely no evidence to frame charges under Section 302 of IPC against the accused. He maintained that there is insufficient ground for proceeding against the accused and prayed that the accused be discharged in the matter.
