The State government has told the Panjim Bench of the Bombay High Court that the petition seeking official disclosure of the health condition of Chief Minister Manohar Parrikar was not maintainable and declined to issue any update on Parrikar’s health.
Hearing a petition filed by politician and activist Trajano D’Mello, the High Court has asked the Chief Secretary to file a reply, on behalf of the government, stating why the petition was not
maintainable.
The petition had sought that the Chief Secretary “immediately conduct medical evaluation of the Chief Minister by a team of expert doctors and to release the medical report to the information of the public”.
D’Mello in his petition claimed that “Parrikar, despite being physically incapacitated, bedridden and in intensive care has breached constitutional trust to remain as Chief Minister and was mentally incapable of discharging his constitutional obligations.”
D’Mello has claimed that the Chief Minister being a constitutional authority cannot claim “immunity” to conceal details of medical reports.
“The acts done and duties performed, are public acts or duties as the holder of public office. Therefore, he owes certain accountability for the acts done or duties performed,” D’Mello argued in his petition.
The State, has until Friday to file its reply, while the petition will be taken up next week.
