Ponda resident gets 3 years jail for attempting to murder uncle

Additional Sessions Court, Panaji has sentenced Eknath Naik of Telaulim, Ponda to three years imprisonment and has imposed a fine of Rs 25,000 for attempting to murder his uncle, Adv Manohar Adpaikar, with a GI pipe in January 2011.

 The court ordered a payment of Rs 10,000 from the fine amount to the victim as compensation.
As per the chargesheet filed by Ponda police, on January 6, 2011, Naik attacked his uncle Adv Adpaikar with a GI pipe at the latter's office in Fonseca building, Tisk, Ponda at around 6.40 pm. The first blow landed on the victim's nose and the second on his shoulder. Even after he fell to this ground, Naik kept hitting his uncle, bloodying his face until he fell unconscious.
The prosecution listed 13 witnesses in support of its case including Adv Datta Tilve, who owns the neighbouring office and was first to run to Adv Adpaikar's help.
The weapon of assault and the blood-stained clothes of the accused were recovered at his instance by the police from two different locations in Ponda.
In addition to this, the doctor from Department of ENT at GMC Hospital, Bambolim, who examined Adv Adpaikar, stated before the court that the X-ray showed a nasal fracture and that if no immediate medical treatment was given to the victim, the grievous injuries could have been fatal.
Based on the evidence on record, the court noted that the accused stopped hitting his uncle when he lost consciousness thinking that he had achieved his plan of murdering him.
